Special Terms for Providers and Clients of Domestina

I. Terms for Providers (individuals and legal entities)
1. General Principles
1.1. The Provider uses the Domestina platform to publish a profile, accept bookings, and deliver services to Clients.
1.2. Domestina is not a party to any service agreement concluded between a Provider and a Client. Domestina does not control how or under what conditions services are performed.
2. Requirements for Providers
2.1. All Providers (individuals and legal entities) agree to:
- possess valid permits and legal grounds to offer services in Spain;
- comply with applicable labor, tax, social security, and immigration laws;
- provide only truthful and up-to-date information in their profile;
- keep records of services performed, if required by law.
2.2. Domestina has the right to request copies of documents proving legal activity, such as NIE, work permit, autónomo registration, CIF (for companies), invoices, tax IDs, and others.
2.3. The Provider accepts that the platform may assign a "Verified" status after document review, without this constituting a guarantee or legal certification by Domestina.
3. Conduct and Service Obligations
3.1. The Provider agrees to:
- complete accepted orders on time and in good faith;
- notify the Client and the Platform immediately in case of changes or inability to perform the service;
- protect the Client's property and personal privacy;
- not subcontract the service to third parties without the Client's knowledge and consent;
- act respectfully and not discriminate based on gender, race, nationality, religion, sexual orientation, or other factors.
3.2. Domestina reserves the right to remove profiles in the case of repeated complaints, suspected illegal activity, or inappropriate conduct.
4. Financial Terms and Payments
4.1. The Provider is fully responsible for:
- issuing invoices (if applicable);
- paying VAT, taxes, and social and health insurance contributions;
- filing declarations with the tax and social security authorities.
4.2. Domestina does not withhold or remit taxes and does not act as a tax agent.
5. Release of Liability
The Provider releases Domestina from all claims, damages, fines, or legal disputes related to their activity, including those arising from legal violations or relationships with Clients.
II. Terms for Clients
1. General Principles
1.1. The Client uses the Domestina platform to find and book services provided by independent Providers.
1.2. Domestina is not a party to the agreement between the Client and the Provider, is not an employer, and is not responsible for the quality or content of the services provided.
2. Selecting a Provider
2.1. The Client selects a Provider at their own discretion and is responsible for verifying:
- the Provider's reviews and rating;
- whether the Provider is marked as "Verified" (if desired);
- direct communication with the Provider regarding expectations, location, scope of work, and conditions.
2.2. Domestina does not guarantee the legal status of Providers, even when their profiles are marked as "Verified."
3. Client Obligations
3.1. The Client agrees to:
- provide accurate and complete information regarding the service location and requirements;
- facilitate access to the premises;
- pay the amounts due under the platform's conditions;
- not request or negotiate illegal services or direct contact outside the platform to circumvent the system.
3.2. Domestina reserves the right to restrict access to Clients who attempt to use the platform for illegal or malicious purposes.
4. Cancellations and Complaints
4.1. In case of unsatisfactory service, the Client may submit a report to the platform, which may, at its discretion:
- mediate between the parties;
- offer compensation or a refund if the terms allow.
4.2. All legal claims must be directed to the Provider.
5. Limitation of Liability
5.1. Domestina is not liable for:
- delays, no-shows, or inappropriate behavior by the Provider;
- property damage, loss, harm, or dissatisfaction with service quality;
- the legal status, labor, or insurance obligations of the Provider, or their actions.
5.2. The Client uses the Platform at their own risk.
